Frequently asked questions

What is the distance-based validity rate for normal and ODC cargo?

Effective 1 January 2021, for regular cargo, validity is 1 day for every 200 km (or part thereof). For Over Dimensional Cargo (ODC) and multimodal shipments where at least one leg involves a ship, validity is 1 day for every 20 km (or part thereof).

When does an E-Way Bill expire during the day?

Under the Explanation to Rule 138(10), validity is counted up to midnight of the last valid day. For example, if a 1-day E-Way Bill is generated on 1st October at 11:00 AM, it remains valid until 2nd October at 23:59:59 (midnight).

When can an E-Way Bill be extended on the GST Portal?

Under the second proviso to Rule 138(10), the transporter or generator can extend the validity period on the official portal within 8 hours before the expiry time or within 8 hours after the expiry time. Once 8 hours after expiry have elapsed, the E-Way Bill cannot be extended.

What is the threshold limit for generating an E-Way Bill?

For inter-state movements, an E-Way Bill is mandatory if the consignment value exceeds ₹50,000. For intra-state movements within a state, the default threshold is ₹50,000, but several states have increased it to ₹1,00,000 (such as Maharashtra, Delhi, West Bengal, and Bihar for non-sensitive goods).

What are the penalties under Section 129 if goods are intercepted with an expired E-Way Bill?

As amended by the Finance Act 2021 (w.e.f. 01.01.2022), Section 129 imposes a penalty equal to 200% of the tax payable if the owner of the goods comes forward. If the owner does not come forward, the penalty is higher of 50% of the value of goods or 200% of the tax payable. For exempt goods, the penalty is capped at ₹25,000.

Can goods be provisionally released after detention under Section 129?

Yes. Under Section 129(1)(c), the seized vehicle and goods can be provisionally released upon furnishing a bank guarantee equal to the penalty amount in Form GST MOV-08.
