Frequently asked questions

What is the daily rate of GST late fee for GSTR-3B and GSTR-1?

For regular returns with tax liability, the late fee is ₹50 per day of delay (₹25 CGST + ₹25 SGST). For Nil returns (where there are zero outward sales and zero tax liability), the late fee is reduced to ₹20 per day (₹10 CGST + ₹10 SGST).

What are the maximum statutory caps on GST late fees under Notification 19/2021?

The Government rationalized late fees via Notification No. 19/2021-Central Tax: (1) Nil returns: maximum ₹500 (₹250 CGST + ₹250 SGST); (2) Taxpayers with Aggregate Turnover up to ₹1.5 Crore: maximum ₹2,000 (₹1,000 CGST + ₹1,000 SGST); (3) Taxpayers with Aggregate Turnover between ₹1.5 Crore and ₹5 Crore: maximum ₹5,000 (₹2,500 CGST + ₹2,500 SGST); (4) Taxpayers with Aggregate Turnover above ₹5 Crore: maximum ₹10,000 (₹5,000 CGST + ₹5,000 SGST).

Is Section 50(1) interest calculated on gross tax or net cash liability?

Section 50(1) interest is calculated strictly on NET CASH TAX LIABILITY (the amount paid by debiting the Electronic Cash Ledger after offsetting available ITC). The Proviso to Section 50(1) was amended retrospectively with effect from July 1, 2017 by the Finance Act 2021. If your tax liability is 100% discharged through ITC, zero interest is payable under Section 50(1).

What is the annual interest rate for delayed GST payment?

The standard interest rate for delayed payment of output GST liability under Section 50(1) is 18% per annum, calculated on a daily basis (Days of Delay / 365).

What is the interest rate for wrongly availed and utilized ITC?

Under Section 50(3) read with Rule 88B(3), interest is charged at 18% per annum (reduced from 24% by Finance Act 2022 retrospectively). Importantly, interest applies ONLY if the wrongly claimed ITC was actually utilized to pay output liability. If it remained unutilized as a balance in your Electronic Credit Ledger, no interest is payable.

How and when are GSTR-1 late fees paid?

Late fees for delayed filing of GSTR-1 are not paid directly when filing GSTR-1. Instead, the GST portal auto-populates the accrued GSTR-1 late fee into Table 5.1 of the subsequent tax period's GSTR-3B return, where it must be discharged in cash.
