Frequently asked questions

What is the enhanced Section 10(10AA) statutory limit for private employees?

The Central Board of Direct Taxes (CBDT), via Notification No. 31/2023 dated 24th May 2023, increased the lifetime statutory exemption ceiling for non-government employees from ₹3,00,000 to ₹25,00,000 for retirements or resignations occurring on or after 1st April 2023.

Is leave encashment exemption available under the New Tax Regime (Section 115BAC)?

Yes! Section 10(10AA) is a statutory exemption on terminal retirement benefits, not a Chapter VI-A deduction. Unlike HRA or LTA, leave encashment exemption is fully available under BOTH the Old Tax Regime and the New Tax Regime.

Are PSU and nationalised bank employees treated as government employees?

No. For the specific purpose of Section 10(10AA), only Central Government and State Government employees qualify for unlimited exemption under clause (i). Employees of PSUs, nationalised banks, statutory corporations, and local authorities are governed by clause (ii) (non-government limits up to ₹25 Lakh).

Is leave encashment upon voluntary resignation also tax-exempt?

Yes. Courts including the Bombay and Madras High Courts have held that the statutory phrase 'on retirement whether on superannuation or otherwise' in Section 10(10AA) includes voluntary resignation from service.

How is leave encashment taxed during active continuing service?

Any leave encashment received while continuing in employment (not on retirement or resignation) is fully taxable as salary in the year of receipt for all employees, including government staff. However, you can claim relief under Section 89(1) by submitting Form 10E.

What happens if an employee passes away during service?

As clarified by CBDT Circular No. 309 dated 03-07-1981, leave encashment paid to the legal heirs or family of an employee who dies while in service is completely exempt from income tax.
